Use of the Site

You may use this site for lawful purposes only. You may not attempt to gain unauthorized access to any part of it, interfere with its operation, submit another person's details as your own, or use automated systems to submit audits or extract content without written permission.

The Brand Audit

The Brand Audit is a diagnostic instrument. It scores the answers you give it and does not verify them, so a self-reported score is a measure of what you reported, not a substantiated finding. The Rapid 25 is free. The Unrivaled 50 is free and available by referral code; codes may be limited in uses, may expire, and may be withdrawn. Taking the audit requires agreeing to receive your report by email and to these terms; permission for marketing emails is separate and optional, as described in the Privacy Policy.

Do not enter confidential information or another person's private details into any audit. Submitted records can be read by people at Mashman Consulting Group LLC.

The Workplace Audit and Other Engagements

The MCG Workplace Audit and all consulting and speaking engagements are governed by the separate written agreement executed for that engagement. Where those terms conflict with these, the engagement agreement controls. Fees and refunds follow that agreement and the Refund Policy. Individual participants in a Workplace Audit see their own results; their organization receives only aggregate findings.

Records of a Client Engagement

When you become a client of Mashman Consulting Group, or book a consultation with the firm, the firm keeps the record of the engagement (what it delivered and when, the files and messages exchanged, and when items were shown to you, downloaded or watched) for seven years after the engagement ends, or after your last consultation if you did not become a client, to perform its agreement with you, meet its record-keeping duties, and protect both parties if a dispute arises. Deleting your account removes the rest of your account, except records of a purchase, kept for tax and accounting. The Privacy Policy sets out what is kept and why. Accounts of the firm’s own team are managed by the firm.

Studies, Quizzes, and Surveys

Participation is voluntary. By submitting responses you allow Mashman Consulting Group LLC to use them in research, reports, presentations, and published content in aggregate form that does not identify you.

Intellectual Property

All content on this site, including text, design, graphics, logos, and marks, is the property of Mashman Consulting Group LLC or its licensors. Identity Positioning™, Identity Positioner™, and Identity Quest™ are trademarks of Mashman Consulting Group LLC. The methodology, the audit instruments, their questions, and their scoring models are proprietary. Identity Positioning: A Macroscopic View on Personal Branding and Personal Branding: A Manifesto on Fame and Influence are the copyrighted works of Isaac Mashman: you may quote them briefly with attribution and link to them, but not reproduce them at length or use them to train a machine learning model without written permission.

You may share your own results, share links, and share images freely. You may not copy any instrument, its questions, or its scoring to build a competing product.

Mashman Consulting Group LLC does not guarantee any specific outcome from an audit, an engagement, or the use of any framework described here. Results depend on factors outside the firm's control, including the work you do.

Products described as in development, including Identity Positioner™, are described for information. Availability, features, and timing may change, and nothing here is a commitment to deliver them on a particular date.

The Name Generator

The Name Generator suggests names; it does not check whether a name is available, registered, or trademarked by anyone, and a suggestion is not legal advice. Locking a name in removes that exact name from the generator so it is not suggested to anyone else. It does not register, reserve, license, or protect the name anywhere.

We claim no ownership of any name the generator produces. In the eyes of Mashman Consulting Group, a name you generate and lock in is a gift to you: yours to use, with no claim, license, fee, or credit owed to us. Because we never own it, we cannot give you exclusive or legal rights in it; locking it only stops the generator from suggesting it to anyone else, and registering or protecting it is yours to arrange.

You are responsible for checking a name before you use it, including domains, social handles, company filings, and trademarks, and for consulting an attorney where it matters. The same or a similar name may occur to someone else independently. We may release a lock that was made in error or used to abuse the generator.

UnrivaledMCG

UnrivaledMCG, at learn.identitypositioning.com, is the learning platform of Mashman Consulting Group. Programs and everything in them, including videos, documents, and quizzes, belong to Mashman Consulting Group or its licensors and are licensed to you for your own learning while you have access. Do not share your account, redistribute program material, or record and republish videos. Access to a program comes from joining a free program, an invitation from Mashman Consulting Group or one of its consultants, a purchase, or a grant from us, and may end if an account is misused.

A record of completion shows that you completed a program's required lessons. It is not a certification, license, or credential of any kind.

In discussions, be respectful and stay on topic. Do not post anything unlawful, harassing, misleading, or confidential to someone else, and do not advertise. Moderators may hide or remove posts and close threads, and we may suspend an account that breaks these rules. You keep ownership of what you post and let us display it to members of that program.

The Other Free Tools

The other free tools, from the pitch builder to the habit tracker, are provided free, as they are, for your own use. What they write is a starting point built from what you entered, not professional or legal advice, and you are responsible for what you publish. The Seamless Branding Report Card grades only what you type in; it does not look up, verify, or monitor any account. The Power of 3 Tracker keeps the details of people you meet on your own device; you are responsible for treating their information with care. Without an account, your work is stored only in your browser, and we cannot recover it if your browser's data is cleared. With the optional free MCG account, your saved work is also kept in that account until you delete it, on the About the Tools page.

Identity Quest™

Identity Quest™ is a free educational simulation. In-game figures, thresholds, categories, and prices exist for gameplay and are not statements of fact about Mashman Consulting Group, its methodology, or its pricing.

Limitation of Liability

These terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles.
